New Jersey's new Red Flag gun control law, signed by Governor Murphy in June, goes into effect on September 1, 2019. Under this law, N.J.S.A. 2C:58-20, individuals will be able to file gun violence restraining orders against persons believed to be a significant risk of harming either themselves or others. This law gives judges the authority to review evidence presented by the petitioner and order that individuals determined to be at risk of harming themselves or others be required to remain away from firearms for a period of up to one year. Additionally, if the individual in question already owns a gun, these extreme risk protection orders would allow law enforcement officers to confiscate firearms for the duration of the order. New Jersey is the tenth state to enact this type of gun control legislation.
