Driving Under The Influence Of Drugs
In New Jersey, drunk driving charges aren’t limited to alcohol intoxication. You can be charged with DWI/DUI if you have consumed controlled substances, such as marijuana or cocaine, or certain prescription medicines, even if they were legally prescribed to you.
The stakes are high in a DWI/DUI case. If you are convicted, you face severe penalties. The best way to protect yourself is to contact an experienced criminal defense lawyer immediately.
Located in East Brunswick, The Law Offices of Thomas Carroll Blauvelt, LLC, has defended thousands of people, just like you, against drugged driving charges. I don’t take DUI charges lying down; I put up a fight. I challenge the evidence and do everything in my power to undermine the prosecution’s case, and I get results.
How Is Drug Intoxication Identified?
The New Jersey Drug Expert program was developed in the 1970s to train police officers to determine whether an individual is under the influence of drugs. When police pull you over for a traffic violation or erratic driving behavior, they also look for signs of drug use.
Unlike a typical DWI/DUI, there is no breath test to determine drug impairment. Instead, you will be brought into the police station for a blood or urine test. A drug recognition expert (DRE) will be called in to evaluate you for symptoms consistent with drug use. However, this evaluation is based almost entirely on visual inspection and vital signs, and DREs often make mistakes.
As your attorney, I will challenge the DRE’s evaluation and will fight to have any blood or urine test thrown out. With over 28 years of experience, I know the defenses that work. I will fight to protect you against the heavy hand of the criminal justice system.
