Jail Alternatives

A New Jersey DWI conviction carries some serious penalties, including: fines, jail time, probation, drug and alcohol education classes, drivers’ license suspension and community service. For many, jail is the most devastating aspect of the punishment not only because of the location but also because time spent in jail means time spent away from work. With many DWIs costing any individual thousands of dollars (if not more), serving time in jail is something many offenders simply cannot afford to do. New Jersey DWI jail alternatives exist not only to punish an offender for bad behavior but also to help limit the lasting impact a jail sentence may otherwise have on an individual’s professional or personal life.

House arrest (via electronic monitoring programs), weekend jails and hour for hour exchanges are not viable options for third-time DUI offenders. For those individuals who have 180 days mandatory jail time, it is possible to reduce the length of the time spent in jail by 90 days and fulfill the rest of the term in an in-patient rehabilitation center approved by the NJ IDRC — a jail alternative that also gives the offender a chance to address any issues he or she may have with drugs or alcohol. Another alternative to jail in New Jersey is to participate in the Sheriff’s Labor Assistance Program (SLAP) in which DWI offenders serve “jail time” by working in designated facilities and community service projects. This alternative is not available to third-time DWI offenders.

Of course, whether any type of New Jersey jail alternative is available or not will depend on the specifics of your case, your DWI history, your criminal record and the judge in your case. For many, a jail alternative is what an offender needs to stay afloat during this difficult time, because it provides an opportunity to still make money for his living. Working with an experienced New Jersey DWI attorney can help get you the jail alternatives you want in your case, or better, get the charges against you dismissed.
