Dangerously Broad Definitions For A Serious Offense

Arguably one of the most troubling aspects of these cases is that the definition of each offense is based on the subjective view of the officer. The truth is that almost anything could fit under either of the two extremely broad definitions.

Under New Jersey law:

  • Careless driving is defined as “driving carelessly without due caution” in such a way that it is likely to endanger people or property. It is a two-point offense.
  • Reckless driving is defined as driving a vehicle “heedlessly, in willful or wanton disregard of the rights or safety of others” in such a way that does or could endanger people or property. It is a five-point offense. A first offense is punishable with 60 days in jail and/or a fine. A subsequent offense is punishable with three months in jail and/or a fine.
